timedbids Sunset Auction User Agreement

By using the timedbids web site (the "Website") or establishing an account with timedbids.sunsetauction.com service (the "Service"), you agree to the following terms and conditions (the Agreement")

• A bid fee aka buyer's premium is charged on all items.  In the State of Washinton, the buyer's premium is taxable.
  
• You acknowledge that you must be 18 years or older to use this site.  Bidding on this web-site is only available to those who can enter a legally binding contract.
  
• You acknowledge that you bear sole responsibility for keeping your password secure.
• You agree not to use this site for any illegal or unauthorized purpose.
• You agree to comply with all local laws regarding online conduct
• You agree not to modify, adapt or hack this site or modify another website so as to falsely imply that it is associated with this site.
• You agree not to transmit any viruses or any code of a destructive nature
• The site reserves the right to modify or terminate any service for any reason at any time, with or without notice.  Some cause for terminations are:  (a) We believe that you are not abiding by the general rules of this web-site (b) You have repeatedly broken a certain term (c) You have listed a suspicious item (d) We believe you to be a non paying bidder.
  
• The site reserves the right to alter this User Agreement at any time.
• The site reserves the right to refuse service to anyone for any reason at any time.
• The site may remove content submitted in public questions.
• You can request your your account be removed at any time by contacting the site administrator provided all financial transactions are completed.

Buyer Purchasing Obligations

A buyer is obligated to complete the transaction of a purchase of an item on this site within three (3) days of the auction closing. A bid is a commitment to buy.

Buyers remorse is not a valid reason for non completion of winning bids.  Prior to making a purchase, buyers should review and research all items.  The majority of items on this site are second hand in nature and may have age and use related conditions.

Miscellaneous Terms and Conditions

This site may, without notice, limit your activity, or suspend or remove your account  immediately (without refunding any fees) and refuse services to you if:
(a) you breach this agreement or other policy documents and guidelines;
(b) The site is unable to verify and authenticate your information; or
(c) The site believes that your actions could cause financial loss or legal liability for you, the site or other users.

No Warranty: SUNSET AUCTION PROVIDES THIS SITE  AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY.

Limitation On Liability: IN NO EVENT SHALL SUNSET AUCTION OR CONSIGNORS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR SITE.  This site acts as a platform for sellers to conduct auctions and for bidders to bid on sellers' auctions. We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items listed, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. We cannot and do not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on. In addition, note that there are risks of dealing with underage persons or people acting under false pretense.
This Web-site shall not be responsible for any items sold by Auction, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller. This web-site shall not be responsible for the cost of procurement of substitute goods or any losses resulting form any goods purchased or obtained.
This web-site assumes no liability for the content of the listings

Your Conduct.
Sellers are solely responsible for the contents of their listed auctions through this web-site. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. You must check that you are entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation.
You must not transmit through the service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law or regulation.
